Ramps.co.uk Terms and Conditions for the Sale of Goods

DEFINITIONS

Company means Easibathe Limited (incorporating Easiaccess) of Independence House, Federation Way, Lancaster Road, Dunston, Tyne and Wear, NE11 9JR. Company number 03739301.

Customer means the person or organisation who submits or places an order to buy the Goods from the Company, or who otherwise directly receives the benefit of these.

Goods means the products which the Company is to supply.

Contract means the Contract for the purchase of the Company’s Goods always subject to the conditions.

Conditions means the terms and conditions of sale set out on this form and any Special Conditions.

Price means the total cost for the Goods and/or Services, as set out on the Sales Order/Invoice.

 

1. CONDITIONS APPLICABLE

  1. These Conditions shall apply to all Contracts for the sale of Goods by the Company to the Customer.
  2. All orders for Goods shall be deemed to be an offer by the Customer to purchase Goods pursuant to these Conditions.
  3. Acceptance of delivery of the Goods at order stage, shall be deemed conclusive evidence of the Customer’s acceptance of these Conditions.
  4. Any variation to these Conditions must be agreed in writing by the Company.

 

2. OPENING AN ACCOUNT AND ORDERING GOODS

    1. When the Customer place an order, they may choose to open an account, or purchase the Goods as a guest, without having to open an account.
    2. For both methods, the Company will require some compulsory personal information. Please see our Privacy Policy, for details on how we use your personal information
    3. The Customer must be over the age of 18 and provide true, accurate and up to date information at all times. For account holders, this information can be updated by going to Your Account.

 

3. GOODS

  1. The Company shall sell, and the Customer shall purchase, Goods in accordance with the Customers order.
  2. The Price of the Goods are exclusive of VAT, chargeable at the applicable rate, unless exemption applies.
  3. We reserve the right to change Prices without prior notice, at any time. The Prices charged will be those on the website at time of ordering.
  4. The Customer shall be responsible for ensuring the accuracy of their order.
  5. All Goods are subject to availability.
  6. Packaging may vary from that shown on the website.
  7. We endeavour to show the colours of our products accurately, however, we cannot guarantee your view of the colours, due to possible screen discrepancies.
  8. All measurements and dimensions stated, are for guidance only.

 

4. PRODUCT GUARANTEE

    1. A standard 12-month guarantee applies to all Goods purchased, unless specified for each product, on the website.
    2. The Customer has certain rights as a consumer. If you require further information, please contact your local Trading Standards office or Citizens Advice Bureau.

 

5. DELIVERY OF THE GOODS

  1. Delivery of the Goods shall be made by the Company to the place agreed with the Customer, as noted on the quotation/sales order.
  2. Goods being sent from the UK mainland, shall be subject to the relevant International Commercial Terms.
  3. All delivery times and dates quoted by the Company, are approximate and are not guaranteed.
  4. The Company shall not be liable for any delay in delivery of Goods.
  5. The Customer shall make all necessary arrangements to take delivery of the Goods.

 

6. TITLE AND RESPONSIBILITY

  1. The Goods shall be the Customers responsibility following delivery.
  2. Ownership of the Goods shall not pass from the Company until the Customer has paid the Price in full.

 

7. CANCELLATION/RETURN OF GOODS

  1. These conditions do not affect your statutory rights as a Customer.
  2. The Customer has the right to cancel all or part of the order, anytime up to 14 days after receiving the Goods.
  3. The Customer must notify the Company within 14 days of delivery if they wish to return the Goods. The Customer then has a further 14 days to return the Goods at their cost.
  4. In the event of Goods being returned owing to defect, failure or related issue, a full refund will be made.
  5. The Company reserves the right to instruct the Customer on the most appropriate method of return.
  6. All Goods returned must be in their original packaging and secured for carriage.
  7. Non-standard/bespoke products are not eligible for return or credit.
  8. All refunds will be credited to the payment method used to purchase the Goods.

 

8. COMPLAINTS

    1. If the Customer wishes to formally complain, they should write to: The Customer Service Manager at info@easiaccess.co.uk or by post to: Easiaccess Ltd, Independence House, Lancaster Road, Dunston, NE11 9JR
    2. The complaint will be acknowledged and if not resolved within 5 working days, the Company will provide regular feedback until it is resolved.

 

9. COPYRIGHT AND INTELLECTUAL PROPERTY

    1. The use of resources on the website e.g. brochures, images, instructions, policies etc. other than for personal consumption, is prohibited.
    2. The Customer must not copy any aspect of the website.
    3. The Customer must not copy any product, or part thereof, appearing on the website.
    4. The Company is not responsible for privacy practices, or any other content of any sites, that are linked to the website.

 

10. CONTRACT PERFORMANCE EXCLUSION

  1. Neither party shall be liable to the other for any loss of use, revenue, profit (inc. anticipated), increased costs, expenses, wasted expenditure, loss of any contract, special damages, any direct, indirect, or consequential losses or damages, which may be suffered by any party arising out of, or in connection with this Contract.

 

11. DATA PROTECTION AND CONFIDENTIALITY

  1. The Company will take all necessary precautions to keep the personal details of the Customer’s order and payment secure.
  2. The Company will only use the personal information provided by the Customer for the purpose of fulfilling the Customers order and in accordance with the Data Protection Act 2018.
  3. Each party to the Contract agrees that the information will be treated as private and confidential and neither party shall publish or disclose any detail to any third party.

 

12. ASSIGNMENT, WAIVER AND THIRD-PARTY RIGHTS

    1. We reserve the right to update or amend these Terms and Conditions, at any time, without prior notice.
    2. The Customer may not assign or pass any of their rights, under these Terms and Conditions, to any third party, unless the Company agrees in writing.
    3. These Terms and Conditions are subject to the laws of England and Wales.
    4. If you are not happy with the way we deal with any disagreements, and you want to take court proceedings, you must do this within the UK.

 

13. FORCE MAJEURE

    1. The Company shall not be liable for any loss or damage caused by circumstances beyond the Company’s reasonable control, including but not limited to an Act of God, war, civil disturbance, governmental restrictions, import or export regulations, industrial disputes, and difficulties in obtaining labour or materials. Should any such event occur the Company is entitled to cancel or suspend any Contract without incurring any liability for any loss or damage caused.
